A wrongful death can be a result of an accident, reckless conduct, or deliberate act of another person/entity that causes the death of an individual.

The sudden and unexpected loss of a loved one that was caused by another person’s recklessness or wrongdoing can be devastating. If you file a wrongful death claim against a negligent person, entity, or company, the surviving family members can sue to recover compensation to help with the expenses and losses that often occur after a wrongful death.

In Arizona, the courts allow a surviving spouse, surviving children, parents/guardians, or representatives of the deceased’s estate to file a wrongful death claim. A settlement can include damages for loss of income, funeral/burial expenses, medical expenses, pain and suffering, loss of consortium, and punitive damages.

In order to have a successful claim, you would need to prove that the other individual owed your loved one a duty of care while they were alive and broke that duty through an act of negligence. It is important to note that in Arizona, survivors must file a wrongful death claim within two years of the death in order to be eligible for compensation.
